TITLE IX: Protocol For Investigating Sexual Harassment/Retaliation
Title IX of the Education Amendments of 1972 prohibits discrimination based on sex in education programs and activities that receive Federal financial assistance. Title IX applies, with a few specific exceptions, to all aspects of federally funded education programs or activities, including all of the operations of educational institutions that receive Federal financial assistance.
The 2020 Title IX regulations (Effective August 14, 2020) issued by the U.S. Department of Education are governing and enforced.¹ The 2020 Title IX regulations effectuate Title IX's prohibition against sex discrimination by requiring recipients to address sexual harassment as a form of sex discrimination in education programs or activities. The regulations obligate recipients to respond promptly and supportively to persons alleged to be victimized by sexual harassment, resolve allegations of sexual harassment promptly and accurately under a predictable, fair grievance process that provides due process protections to alleged victims and alleged perpetrators of sexual harassment, and effectively implement remedies for victims.

Protocol For Reporting & Investigating Sexual Harassment & Retaliation Pursuant to Title IX
¹ A January 9, 2025 federal court decision vacated the 2024 Title IX Rule in all jurisdictions, and on January 31, 2025 and February 4, 2024 the U.S. Department of Education issued “Dear Colleague” letters to notify K-12 schools and institutions of higher education that the the Department will be enforcing the 2020 Title IX Rule.
